Please read these Terms of Service (“Terms”) carefully. By using the software, services, or websites provided by Tiny Pig and its subsidiaries, you agree to these Terms. If you do not agree, please do not use these software, services, or websites.

Software, Services, and Websites.
Tiny Pig and its subsidiaries (collectively referred to as “TinyPig,” “we,” or “the Company,” as applicable) are the leading ecosystem providing connected software and services for professional e-commerce sellers. We offer a variety of tools and expertise designed to improve efficiency, drive profitability, and enable scaling through data intelligence. The TinyPig ecosystem is owned and operated by TinyPig. Customers. As a customer of TinyPig or as a representative of an entity that is a customer of TinyPig, you are referred to in this agreement as the “Customer” (or “you”). You represent that you have full power, capacity, and authority to accept these Terms on behalf of yourself or your employer. Account Requirements. To set up an account and use TinyPig software, services, and/or websites, you must:
Be at least 18 years old, or the legal age of majority in your province, region, or country, to become a customer. Individuals under 18 or the legal age of majority may only use the software, services, and/or websites with the involvement of a parent or legal guardian, and such accounts must comply with these Terms.
Provide your legal full name, a valid email address, and any other information we require to complete your account registration process.
Provide one or more payment methods. “Payment methods” refer to currently valid and accepted payment options, which may be updated from time to time, including payments made through third-party accounts.
Create your account personally and manually, not using any automated means, except for autofill functions provided by your internet service provider. Third parties may not create accounts for you, nor may you allow any third party to use your information to create an account. Account Ownership. Customers who create accounts and pay fees (“Account Owners”) have access to and control over the account and are responsible for any activities conducted through that account. To maintain control of the account and prevent unauthorized access, Account Owners should keep access to the service secure and not disclose any passwords or payment method details associated with the account to anyone. Account Owners must not share their account, login, or any other access credentials with others unless explicitly stated in the specific plan details. Except for explicitly authorized multi-user accounts, all accounts are single-user accounts. You are responsible for updating and maintaining the accuracy of the information you provide related to your account. We reserve the right to terminate or suspend your account to protect your and/or our rights. You must immediately notify us of any unauthorized use of your account. We will not be liable for any loss or damage if you fail to comply with these security obligations.
Payment Terms
Disclaimer and Limitation of Liability
Disclaimer. TinyPig and its third-party licensors make no express or implied warranties regarding the products and/or support services or professional services. TinyPig disclaims and excludes implied warranties of merchantability and fitness for a particular purpose, as well as any warranties against infringement of third-party rights. TinyPig does not guarantee that the customer’s use of the product will be uninterrupted, nor that the product will operate error-free or securely, or that it will be compatible with all devices or software configurations of the customer (or its end customers, if applicable), or that the product design will meet all of the customer’s business requirements. No dealer, distributor, reseller, agent, or employee of TinyPig is authorized to modify, extend, or supplement this warranty, and any such terms or statements are not binding on TinyPig. Limitation of Liability. Under no circumstances shall either party’s cumulative monetary obligations and liabilities to the other party or any other party under this agreement, regardless of the form of any claim or lawsuit (whether contract, negligence, strict liability, or otherwise), exceed the payments made or payable by the customer to TinyPig related to the product, support services, or professional services in the twelve (12) months preceding the event giving rise to the claim or lawsuit. The above limitations do not apply to any party’s gross negligence, willful misconduct, or breach of confidentiality obligations; customer’s violation of TinyPig’s intellectual property rights; customer’s payment obligations; or indemnification obligations. Notwithstanding anything to the contrary in this agreement, TinyPig shall not be liable for: (i) disclosure of customer data by authorized users or through product features and settings controlled by the customer; (ii) claims alleging that customer data infringes third-party intellectual property rights; or (iii) damages or losses resulting from any modifications or adaptations to the product made by the customer without TinyPig’s explicit prior written consent.
Except for any party’s gross negligence, willful misconduct, breach of confidentiality obligations, or customer’s violation of TinyPig’s intellectual property rights, under no circumstances shall either party be liable to the other party or any third party for (A) indirect, special, consequential, incidental, or punitive damages, including but not limited to business loss, loss of revenue, profits, and goodwill, or (B) loss or costs related to interruption of use, data loss or inaccuracy, substitute technology, goods, or services, even if a party has been advised of the possibility of such damages.
No Guarantee of Results. TinyPig makes no guarantees or representations of any kind regarding the results of your use of the software, services, and/or website. Any recommendations or examples regarding the software, services, and/or website are merely examples of possible outcomes. No specific results, including increased revenue, Amazon rankings, sales, and/or any other results, are guaranteed based on your use of the software, services, and/or website or any other products, programs, or services we provide. Indemnification for Violation of Terms of Use. You agree to indemnify and hold harmless TinyPig, its officers, directors, shareholders, predecessors, successors, employees, agents, subsidiaries, and affiliates from any third-party claims, losses, liabilities, demands, or expenses (including attorney fees) arising from your use of the software, services, and/or website. Third-Party Resources. The software, services, and/or website may contain links to third-party websites or other resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of such third-party websites or resources. Such links are provided solely for your convenience and do not imply endorsement or affiliation by TinyPig. You acknowledge and assume all risks associated with your use of any such third-party websites or resources.
